RE: The tariff classification of a woman’s vest and a woman’s pullover from Hong Kong

Dear Ms. Baron:

In your letter dated April 26, 2002, on behalf of Polo Ralph Lauren Corp., you requested a tariff classification ruling.

You submitted two garments that are constructed from 70% silk, 30% cashmere, jacquard knit fabric. The outer surface of the vest and the pullover measures more than 9 stitches per 2 centimeters in the horizontal direction. Style 37D21, the vest, features a deep V-neckline, oversized armholes, and a rib knit bottom. The neckline and armholes are finished with rib knit fabric.

Style 37D22, the pullover, features a V-neckline, short sleeves, and a rib knit bottom. The neckline and the sleeves are finished with rib knit fabric.

The applicable subheading for the vest will be 6110.90.1040, Harmonized Tariff Schedule of the United States (HTS), which provides for sweaters…(vests) and similar articles, knitted: of other textile materials: containing 70% or more by weight of silk or silk waste: vests, other than sweater vests: women’s. The duty rate will be 1.9% ad valorem.

The subheading for the pullover will be 6110.90.1060, which provides for pullovers, knitted: of other textile materials: containing 70% or more by weight of silk or silk waste: other: women’s. The duty rate will be 1.9% ad valorem.

The vest falls within textile category designation 759. The pullover falls in category 739. Based upon international textile trade agreements products of Hong Kong are not subject to quota nor the requirement of a visa.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
